Welcome to Nüvi. These Terms of Service ("Terms") govern your use of getnuvi.net (the "Site") and your purchase of any products from Nüvi Herbal Supplements LLC ("Nüvi," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Who Can Use Nüvi

Our products are intended for adults. By using the Site or placing an order, you confirm that you are at least 18 years old and able to enter into a binding agreement. Keep our products out of reach of children. Consult a pediatrician before any use with anyone under 18.

2. Products, Pricing, and Availability

We do our best to describe and price our products accurately, but we can't guarantee every detail is error-free. We reserve the right to correct any errors, change prices, and update or discontinue products at any time without notice. If we cancel an order because of a pricing or availability error, we'll refund any payment you've made for that order.

3. Orders and Payment

When you place an order, you're making an offer to buy, which we may accept or decline. Payment is due at checkout through our payment providers. You're responsible for providing accurate billing and shipping information. We reserve the right to refuse or cancel any order, including orders we believe are fraudulent or that violate these Terms.

4. Shipping and Delivery

We'll process and ship orders as described at checkout. Delivery times are estimates, not guarantees. Risk of loss passes to you once the carrier takes possession of your order. If a package is lost or damaged in transit, reach out and we'll help sort it out.

Nüvi products are made with natural herbal ingredients and essential oils. They are intended for general wellness and personal use only. Statements about our products have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and nothing on the Site is medical advice.

Always read the label and use products as directed. Discontinue use if you experience any irritation or discomfort. Consult a qualified healthcare provider before use if you are pregnant or breastfeeding, taking medication, have known allergies, or have asthma or other respiratory conditions. You use our products at your own risk and are responsible for determining whether they are appropriate for you.

7. Intellectual Property

The Site and everything on it, including the Nüvi name, logo, scent names, product designs, text, images, and other content, is owned by Nüvi or our licensors and is protected by trademark, copyright, and other laws. You may not copy, reproduce, or use any of it without our written permission, except as needed for your own personal, non-commercial use of the Site.

8. Reviews and Submissions

If you post a review, comment, photo, or other content related to Nüvi, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with our business and marketing. You're responsible for what you submit, and you confirm you have the right to share it. We may remove any content at our discretion.

9. Acceptable Use

When using the Site, you agree not to misuse it, including by attempting to disrupt or gain unauthorized access to it, using it for any unlawful purpose, infringing anyone's rights, or reselling our products without authorization.

10. Third-Party Links

The Site may link to third-party websites or services we don't control. We're not responsible for their content, policies, or practices. Visiting them is at your own risk.

11. Disclaimer of Warranties

The Site and our products are provided on an "as is" and "as available" basis. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Site will always be available, secure, or error-free.

12. Limitation of Liability

To the fullest extent allowed by law, Nüvi and its owners, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim related to a product or order will not exceed the amount you paid for that order. Some states don't allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Nüvi and its owners, employees, and partners from any claims, damages, or expenses arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute relating to these Terms or our products will be handled in the state or federal courts located in Texas, and you agree to that jurisdiction. Before filing anything, we ask that you contact us first so we can try to resolve the issue directly.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we'll post the new version here with an updated date. Your continued use of the Site after changes take effect means you accept the updated Terms.

16. General

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with our Return and Refund Policy and Privacy Policy, make up the full agreement between you and Nüvi.
